Guidelines for a respectful and professional experience with our studio.

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Memorial Art Studio ("we," "us" or "our"), concerning your access to and use of the lovedonephoto.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

2. Service Description (Credit System)

Our Site provides AI-powered image generation tools. Access to these tools is governed by a "Credit System".

  • Purchase: Credits can be purchased in bundles (Starter, Value, Agency).
  • Usage: Each image generation request consumes a pre-defined number of credits.
  • Non-Refundable: Due to the immediate consumption of high-cost computing resources (GPU time), all credit purchases are final and non-refundable once a credit has been used. Unused credits may be refunded within 14 days of purchase upon request, provided no services were rendered.

3. User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. User Generated Content & Licenses

You retain full ownership of any photos or data you upload to the Site ("Source Content"). By uploading Source Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process said content solely for the purpose of generating the requested AI artwork.

Output Ownership: Subject to your compliance with these Terms, you own all rights, title, and interest in and to the images generated by the AI ("Generated Content"). We hereby assign to you all our rights, title, and interest in and to such Generated Content.

5. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. Specifically, you agree not to:

  • Upload content that depicts sexual violence, hate speech, or illegal acts.
  • Use the Site to create "deepfakes" of public figures or private individuals without their consent for malicious purposes.
  • Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Site; (3) breach of these Terms of Use.

8. Governing Law

These Terms shall be governed by and defined following the laws of Turkey. Memorial Art Studio and yourself irrevocably consent that the courts of Istanbul shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
